These Terms & Conditions govern the ordering and use of hostavik's services. They are made up of the General Terms and Conditions, which apply to every service, and the Specific Terms and Conditions, which apply to particular kinds of service. They must be read together with our policies, including our Terms of Use, Privacy Policy and Cookie Policy.
By ordering or using any of our services, you agree to be bound by these terms. If you do not agree to them, please do not use our services. Where the general terms and the specific terms for a service say different things, the specific terms apply to that service.
General Terms and Conditions
Definitions and Interpretation
In these terms:
- "Agreement" means these General Terms and Conditions, the Specific Terms and Conditions that apply to your services, our policies, and the details of each order you place, as updated from time to time.
- "Customer", "you" and "your" mean the person or organization named on the account that orders or uses the Services, and include anyone you allow to use them.
- "hostavik", "we", "us" and "our" mean the business that operates this website and provides the Services.
- "Services" means the services we provide to you, as described on our website and in your order.
- "Fees" means the amounts payable for the Services, as shown on our website or at checkout before you place an order.
- "Supplier" means another company whose products or systems we use to provide a Service, such as a domain registry, a certificate authority or a software provider.
- "Customer Data" means the websites, email, files and other data that you or your users store on or send through the Services.
- "Personal Information" means information about an identifiable person.
Headings are for reference only and do not affect the meaning of these terms. Words in the singular include the plural, and the other way round.
Application and Initiation of Services
- Each order you place is an offer to buy a Service on these terms. A separate contract for that Service begins when we accept the order.
- We may refuse an order, including because of how an account has been used in the past.
- We may ask for information or documents that confirm your identity or your authority to place an order, and may delay or suspend a Service until we receive them.
- You agree to provide accurate and current information when you register and when you order, and to keep your account information up to date.
Commencement and Termination
- This Agreement begins on the date you register an account or order a Service, whichever comes first, and continues for as long as you have a Service with us.
- Each Service runs for the billing period you choose, and then for further periods of the same length until it is cancelled.
- To cancel a service, use the cancellation option in your client area where it is shown, or contact us.
- hostavik reserves the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms & Conditions or is harmful to hostavik's interests or the interests of other users. This includes cases where:
- you commit a serious or repeated breach of this Agreement;
- Fees are not paid in full when they are due;
- information you gave us turns out to be false or incorrect;
- we reasonably believe the Service is being used unlawfully;
- our agreement with a Supplier that the Service depends on comes to an end.
- If a Service is suspended or terminated because of your breach, Fees already paid for it are not refunded, and we may decline future orders from you.
- When a Service ends, the Customer Data held on it may be deleted. Make sure you have your own copy before a Service ends.
Services and Changes to Services
- We offer domain name registration, web hosting, email and related add-on products through this website. The description and price shown when you place an order, together with these terms, make up your agreement with us for that service.
- You are responsible for choosing Services that meet your needs. We may make suggestions based on what you tell us, but we do not warrant that a Service is suitable for a particular purpose.
- We and our Suppliers work to keep the Services available. Unless we agree otherwise in writing, the Services are provided on a best-effort basis, with no guarantee of uptime, speed or capacity.
- Maintenance is carried out from time to time and can interrupt a Service.
- We may change, replace or withdraw a service or one of its features.
Security
- We take reasonable measures to protect our systems, but we do not warrant that security breaches will not occur. Our Security Statement describes how we protect your account.
- You must keep your passwords and access details secure, and must not do anything that puts the security of our systems at risk, including introducing malicious code.
- If you discover or suspect a security breach, tell us immediately, in a way that does not make the risk worse.
- If a breach occurs, or we believe one is likely, we may take the steps we consider necessary to protect our systems, including changing passwords and blocking access.
- You must cooperate with any investigation we carry out into a security breach.
- If you provide services to other people using our systems, you must hold them to security obligations equivalent to these.
Customer Duties
By using hostavik's services, you agree to use our services for lawful purposes only and in compliance with all applicable laws and regulations. You agree not to misuse our services or interfere with their normal functioning.
In particular, you must not use our services to:
- store, publish or send material that is unlawful or that infringes someone else's rights;
- send unsolicited bulk email (spam);
- host or distribute malware, phishing pages or other deceptive content;
- attack, scan or gain unauthorized access to other systems or accounts;
- use resources in a way that harms the service for other customers.
You also agree that:
- You are responsible for maintaining the confidentiality of your account and password and for any activities that occur under your account.
- You will only let people you have authorized use your Services, and you are responsible for what they do.
- You will not resell the Services unless the Service you bought is one that is meant to be resold, such as a reseller hosting plan.
- Each Service has the resources described at the time of order. If your use goes beyond them, we may limit the Service or ask you to move to a larger plan.
- The person or organization named on the account is our Customer. If someone else, such as a web designer, manages Services for you, make sure the account is in your own name. We act on the instructions of the account holder and its authorized users.
Fees, Charges and Payment
- You agree to pay for the services you select in accordance with our pricing and billing policies.
- Services are billed in advance for the billing period you choose at checkout. Before a service is due to renew, we issue an invoice for the next period.
- Taxes are added to the Fees where they apply.
- Payments must be made in full, without deduction or set-off.
- We may change our Fees. A change does not affect a period you have already paid for.
- hostavik reserves the right to suspend or terminate services if payment is not made in a timely manner. After a late payment is received, it can take some time for a suspended Service to be restored.
- If you believe an invoice is wrong, tell us as soon as possible, and before its due date where you can.
- Refunds are covered by the Refund Policy in the Specific Terms and Conditions below.
Intellectual Property Rights and Infringements
- All content provided by hostavik, including but not limited to text, graphics, logos, images, and software, is the property of hostavik or its content providers and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or use any of the content without our prior written permission.
- You keep the rights in your Customer Data. You give us permission to host, copy and transmit it as far as is needed to provide the Services.
- You must not use the Services to infringe anyone's intellectual property rights. If we receive a complaint that content on a Service infringes someone's rights, we may remove it or disable access to it.
Protection of Personal Information
- We handle Personal Information as described in our Privacy Policy and in line with the data protection law that applies to us.
- You are responsible for the Personal Information that you and your users store on or send through the Services, including for having a lawful reason to hold it and for keeping it secure within your own website and applications.
Representations and Warranties
hostavik provides its services on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the availability, accuracy, or reliability of our services. You agree that your use of our services is at your own risk.
Customer Warranties
You confirm that:
- you are legally able to enter into this Agreement and, if you are acting for an organization, that you have its authority to do so;
- the information you give us is accurate and complete;
- you have the right to use the content you place on the Services and the domain names you register through us;
- your use of the Services complies with the laws that apply to you.
Force Majeure
We are not responsible for a delay or failure to provide a service that is caused by events beyond our reasonable control, such as failures of power or communication networks, natural disasters, acts of government, or attacks on our systems or those of our suppliers.
Limitation of Liability and Indemnity
- hostavik shall not be liable for any damages resulting from your use of, or inability to use, our services. This includes, but is not limited to, direct, indirect, incidental, and consequential damages.
- You agree to indemnify and hold harmless hostavik and its affiliates, officers, employees, and agents from any claims, damages, or expenses arising out of your use of our services or violation of these Terms & Conditions.
Breach
If you breach this Agreement and do not put it right within the time we give you in a notice, we may suspend or terminate the affected Services and recover any Fees you owe. This does not limit our right to act without notice in the cases listed under Commencement and Termination.
Dispute Resolution
If you have a complaint or a dispute with us, contact us first, through a support ticket or our Contact Us page, so that we can try to resolve it with you. A dispute that we cannot resolve between us will be decided by the courts named under General below.
Notices
- We send notices to the email address on your account or through your client area. You are responsible for keeping that address current and for reading what we send to it.
- Send notices to us through a support ticket or our Contact Us page.
Consumer Protection
Nothing in this Agreement limits or excludes any right you have under consumer protection law that cannot lawfully be limited or excluded.
General
- We reserve the right to modify these Terms & Conditions at any time. Any changes will be posted on this page, and the date of the last revision will be updated. Your continued use of our services after any modifications constitutes acceptance of those changes.
- This Agreement is the whole agreement between you and us about the Services and replaces anything said or written before it.
- If a court finds part of this Agreement invalid, the rest of it continues to apply.
- If we do not enforce a right under this Agreement straight away, we can still enforce it later.
- You may not transfer this Agreement or a Service to someone else without our consent. We may transfer our rights and obligations to a business that takes over the Services.
- These Terms & Conditions shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any legal action or proceeding arising from your use of our services shall be brought exclusively in the courts of Nigeria.

Specific Terms and Conditions
Hosting Services
Shared, WordPress and reseller hosting
- These plans place many customers on the same servers. Each plan has the resources described at the time of order. We may limit or suspend a service that exceeds them or that puts the platform or other customers at risk.
- Hosting space is for running websites and their email. It is not for general file storage, for backups of other systems or for distributing large files.
- We may move your account to another server, or change its IP address, when that is needed to maintain the platform.
- You are responsible for the websites, email and other content on your services, and for making sure you have the right to use it. Keep your own copy of your website and data: backups included with a plan are a convenience and do not replace your own copies.
- You are responsible for keeping the software on your website, including its themes, plugins and scripts, up to date and secure.
VPS, cloud and dedicated servers
- Unless your plan says it is managed, you manage the server yourself, including its operating system, software, security and backups.
- You are responsible for all activity on the server and for holding valid licences for the software you install on it.
- IP addresses assigned to a server remain ours. They can change, and they return to us when the Service ends.
- If a server is used in an attack or is sending spam, we may disconnect it from the network until the problem is fixed.
Domain Names
- A domain name is registered only when the registry for that extension confirms it. Until then we cannot guarantee that a name is available.
- Domain names are subject to the rules of the registry for the extension and, where they apply, the policies of ICANN. By registering a domain you agree to those rules.
- You must give accurate contact details for the registrant and keep them up to date. Registries can suspend or cancel a domain that has inaccurate details.
- You confirm that, as far as you know, neither the domain name nor the way you use it infringes anyone else's rights.
- Disputes about who is entitled to a domain name are handled under the dispute policy of the registry for that extension, such as ICANN's Uniform Domain Name Dispute Resolution Policy.
- Domains are registered for a fixed period and must be renewed before they expire. Renewing a domain on time is your responsibility, whether or not you receive a reminder from us. An expired domain may stop working, may cost more to restore, and may be released for others to register.
- Some names are classed as premium by their registry and have a higher price, which is shown before you order.
- Registration, renewal and transfer fees cannot be refunded once the registry has processed them.
- Transfers to and from other providers follow the registry's transfer rules and time limits.
SSL Certificates
- SSL certificates are issued by third-party certificate authorities, not by us. A certificate is issued only after the authority has completed its checks, and the authority can refuse or revoke a certificate under its own rules.
- You must give accurate information and complete the validation steps the authority asks for.
- Unless your plan includes it, installing the certificate on your website is your responsibility.
Third-Party Products and Software
- Some products sold through this website, such as SSL certificates, website security, backup, website builder, email and monitoring tools, are provided by third-party suppliers. When you order one, the supplier's own terms also apply to your use of it, and we pass on the details needed to set it up.
- Where software from another company is provided with a Service, you must follow that software's licence terms.
Fair Use Policy
- Where a plan describes a resource as unlimited or unmetered, it means we set no fixed limit on the normal use of a website or mailbox of the kind the plan is meant for. It does not mean unlimited use for any purpose.
- If your usage is far above that of typical customers on the same plan, or affects the performance of the platform, we may ask you to reduce it or to move to a more suitable plan, and may limit the Service in the meantime.
Refund Policy
- All payments are non-refundable unless a refund is offered for that product at the time of your order, or the law requires one.
- Products that we buy from Suppliers on your behalf cannot be refunded once they have been set up. This includes domain name registrations, renewals and transfers, and SSL certificates and other third-party products.
Reseller Terms
- A reseller plan lets you sell hosting accounts to your own customers.
- You are responsible for your customers: for supporting them, for billing them, for their content, and for making sure they follow the rules under Customer Duties above.
- Our agreement is with you. We have no agreement with your customers, do not take instructions from them, and are not involved in disputes between you and them.
- If your reseller Service is suspended or ends, the accounts under it are affected as well.
- You must not present yourself as hostavik, or as acting on our behalf.
Affiliate Programme
These terms apply if you take part in our affiliate programme.
- Commission is earned on qualifying orders, as described in the affiliate area of your account.
- You must not refer yourself, send spam, make misleading claims about our Services, or use our name as a keyword in paid advertising.
- You may use our name and logo only to promote our Services, and must not alter them or suggest that your own website or business is run or endorsed by us.
- We may withhold or reverse commission on orders that are refunded, cancelled, unpaid or fraudulent.
- We may change or end the programme, or your part in it, at any time.
Support and Security
Support
- Support is provided through support tickets in your client area and through our knowledgebase.
- When you ask for help, give us the details we need to look into the problem. We may need to access your Service in order to resolve a request.
- Support covers the Services we provide. It does not cover building, coding or repairing your own website or applications unless that is part of your plan.
Security and Data Protection
- Our Security Statement describes how we protect your account, and our Privacy Policy explains how we handle Personal Information.
- If you believe you have found a security weakness in our website or client area, please follow our Vulnerability Disclosure Policy.
